Service Agreement:
This agreement outlines the terms and conditions governing the recurring gutter cleaning packages provided by Udderly Gutters LLC ("Company"). By subscribing to a recurring cleaning package, the customer ("Customer") agrees to be bound by these terms.
Package Details:
Recurring Cleanings: Udderly Gutters offers various cleaning packages with recurring services, including but not limited to, one, two, or four cleanings per year.
Automatic Renewal: All recurring cleaning packages automatically renew annually on the anniversary of the subscription date.
Package Variations: Pricing varies based on factors including, but not limited to, the selected cleaning frequency, whether the gutters have guards or not, the size of the Customer's home, and the number of stories.
Additional Services: Customers may add supplemental services to their selected package, including additional cleanings, water tests, and snow removal services, at an additional cost. These supplemental services can be added on an as needed basis.
Payment Options: Customers can choose to pay for their selected package monthly or annually. Annual payments are discounted more than monthly payments, and monthly payments are discounted more than the standard a la carte pricing.
Pricing and Payment:
Package Pricing: Package pricing is determined based on the selected package, whether the gutters have guards or not, the size of the Customer's home, and the number of stories.
Price Adjustments: Pricing is subject to change upon renewal of the annual subscription.Notification of Price Changes: The Company will provide the Customer with written notification of any price changes prior to the automatic renewal date.
Payment Due Dates: Payments are due on the scheduled billing date, whether monthly or annually.
Late Payment Penalties: Failure to make a payment on time may result in late payment penalties, up to a maximum of 25% of the past due balance.
Payment Methods: Udderly Gutters accepts Cash, Checks, Credit Cards, Debit Cards through online or direct payment to a service agent, field technician from the team or by delivering it to our Udderly Gutters location located at 28 Lisa Dr, Rindge, NH 03461.
Cancellation Policy:
Cancellation Notice: Customers must provide written notice of cancellation prior to the next scheduled cleaning or renewal date.
Cancellation After Service: If a customer cancels their subscription after a cleaning has been performed during the current subscription year, the Customer will be charged the standard a la carte rate for each cleaning already completed during that subscription period. The remaining balance of the original package price will be adjusted to reflect this change.
Refunds: Refunds for unused services will be processed according to the Company's refund policy, which may be provided upon request.
Service Quality:
Service Guarantee: Udderly Gutters is committed to providing high-quality gutter cleaning services.
Customer Satisfaction: If a Customer is dissatisfied with the service provided, they must notify the Company within 10 days of the service date for resolution.
Service Limitations: The Company is not responsible for pre-existing damage to gutters or related property and reserves the right to refuse repairs deemed not optimal.
Liability:
Limited Liability: The Company's liability for any damages arising from its services is limited to the cost of the services provided.
Force Majeure: The Company is not liable for delays or failures to perform services due to events beyond its reasonable control, including but not limited to natural disasters, weather events, or equipment failures.
Governing Law:
Jurisdiction: This agreement shall be governed by and construed in accordance with the laws of New Hampshire Jurisdiction.
Entire Agreement:
Complete Understanding: This agreement constitutes the entire understanding between the Customer and the Company regarding the recurring gutter cleaning services.
Amendments:
Agreement Changes: The Company reserves the right to amend these terms and conditions at any time. Customers will be notified of any changes in writing.
